In consideration of the Participant being allowed to participate in any way in squash lessons, clinics, training or related athletic programs (the “Activity”) operated by Bancroft Squash Corp. (“Bancroft Squash”), the undersigned acknowledges, appreciates, and agrees that: Risks of Participation: The risk of injury from the Activity is significant and may include but is not limited to: physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability (including paralysis), economic or emotional loss, and death. While particular rules, equipment, and personal discipline may reduce this risk, the above risks still exist. Assumption of Risk: I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the Releasees or others, and assume full responsibility for the Participant's participation. Compliance with Terms: I willingly agree to comply with the stated and customary terms and conditions for participation. If I observe any unusual significant concern in the Participant's readiness for participation and/or in the program itself, I will remove the Participant from participation and bring such attention to the nearest official immediately. I agree not to allow the Participant to participate unless the Participant is medically able. Release of Liability: I, for myself (if an adult Participant) and on behalf of the Participant (if a minor), hereby release and hold harmless Bancroft Squash, its officers, officials, owners, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and owners and lessors of premises used to conduct the Activity (collectively, the "Releasees"), with respect to any and all injury, disability, death, or loss or damage to person or property relating or incident to the Participant's involvement or participation in the Activity. Acknowledgment of Understanding: I have read this waiver of liability, assumption of risk, and indemnity agreement, fully understand its terms, understand that I have given up substantial rights by signing it, and sign it freely and voluntarily without any inducement. Jurisdiction: I agree that this waiver and release of liability is governed for all purposes by Massachusetts law, without regard to any conflict of law principles. This waiver supersedes any and all previous oral or written promises or other agreements. Damages by Participant: In the event of any damage to equipment or facilities occurring as a result of the willful actions of the Participant or the Participant’s family members or agents, I acknowledge and agree to be held liable for any and all cost associated with such actions of neglect or recklessness. Term: This waiver and release of liability shall remain in effect for the duration of the Participant’s participation in the Activity, during this initial and all subsequent events of participation.
